Terms of sale
Seller and scope
These terms apply to any subscription to a paid Handler plan, between the publisher (identified in the legal notice) and the customer organization, represented by its owner. They add to the terms of use.
The customer may be a business, a non-profit or a consumer, meaning an individual acting for purposes outside their professional activity. Provisions that apply only to consumers are marked as such.
The publisher is a sole proprietorship under the VAT exemption scheme.
Plans
The Free plan gives access to the core features, with an unlimited number of servers. The paid Pro plans are for organizations that want more features and longer data retention. They come in tiers based on the number of servers covered.
The content of each plan, its limits and, where applicable, its retention periods are detailed on the Pricing page, which is authoritative on the date of the order.
Prices
Prices are in euros, according to the price list in force on the Pricing page. They exclude tax: VAT not applicable, article 293 B of the French General Tax Code.
If the publisher stops benefiting from the VAT exemption, VAT will be added to the prices from the date it becomes due, with prior notice.
The publisher may change its prices. The new price is announced by email at least 30 days before it applies and applies at the next renewal. If you refuse, you cancel before that renewal. A promotional or launch price is guaranteed for the period stated at the time of the order.
Order
Only the owners of an organization can subscribe. The order is placed in the service: you choose the plan and the billing period (monthly or yearly), give your billing country and, for a business, your VAT number, then pay on Stripe's secure page.
Before paying, you can review your order and correct any mistake. You accept these terms and confirm your order by ticking the box provided and then confirming the payment. The subscription starts when the payment is confirmed. An email and an invoice confirm the order.
Payment
Payment is by bank card through Stripe, which alone processes the card data: Handler neither receives nor keeps it. Payment is due in advance, at subscription and at each renewal.
A yearly subscription is billed once for twelve months, at the price shown on the Pricing page.
If a payment fails, we tell you by email and the Pro plan is kept for a grace period shown on the billing page. If the payment is not settled during that period, the organization goes back to the Free plan.
As payment is due in advance, no late payment penalty applies.
Invoices
An invoice is issued for each payment. It is available on the billing page and through the Stripe portal. Invoices are kept in line with accounting obligations.
Invoices carry the note “VAT not applicable, art. 293 B of the CGI” as long as the publisher is under the exemption scheme.
Term and renewal
The subscription is for one month or one year, as ordered. It renews automatically for the same term, at the price in force, until you cancel it.
If you act as a consumer, we remind you by email, before a yearly renewal, of the deadline to object to it.
Cancellation
You can cancel at any time from the billing page, using the Stripe portal. Cancellation takes effect at the end of the period already paid: you keep the Pro plan until then. There is no cancellation fee.
Except where the law or these terms provide otherwise, the period already started is not refunded pro rata.
Handler may cancel a subscription for a serious breach of the terms of use, as those terms provide. If Handler cancels for any other reason, the amounts paid for the period not yet elapsed are refunded pro rata.
Changing plan and going back to free
You can change plan from the portal. Moving to a higher plan applies immediately. Moving to a lower plan, or the end of the subscription, applies at the end of the paid period.
Going back to the Free plan does not delete your data at that moment: only the features and limits change. Today, raw game event detail is kept without a time limit on every plan. If a retention period is set for the Free plan, it will be announced with notice before it applies, and raw detail beyond it can only be deleted after an email that tells you so. Aggregates are kept.
Consumers' right of withdrawal
If you are a consumer, you have 14 days from the subscription to withdraw without giving a reason. To exercise this right, write to the contact address, or use the form below, before the period ends.
Model form: “To [publisher and contact address]. I hereby notify you of my withdrawal from the contract for the supply of the following Handler subscription: [plan], ordered on [date]. Name: [name]. Address: [address]. Date: [date].”
Handler supplies a digital service that starts as soon as you subscribe. When you pay, you expressly ask for the service to start before the withdrawal period ends. If you then withdraw, you pay an amount proportional to what was supplied until your request. You also acknowledge that you lose your right of withdrawal once the service has been fully performed.
The refund, if due, is made within 14 days of your request, by the same means of payment. When you subscribe, Handler records the version of the terms you accept, your request for immediate performance and the date, with a hash of your IP address.
The right of withdrawal does not apply to businesses, except under the conditions of article L. 221-3 of the French Consumer Code.
Refunds
Apart from the right of withdrawal and the cases provided by law or by these terms, no amount is refunded for the current period. The publisher may decide on a goodwill gesture, which does not create a right.
A refund is made by the means of payment used, through Stripe.
Legal guarantees
If you are a consumer, you benefit from the legal guarantee of conformity of digital content and services (articles L. 224-25-1 et seq. of the French Consumer Code) and from the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).
In case of a lack of conformity, you can ask for the service to be brought into conformity; failing that, a price reduction or termination of the contract, as provided by law.
Customer service and complaints
For any question or complaint about an order, write to the contact address: [email protected]
We answer as soon as we can, usually within a few working days.
Force majeure
The publisher is not liable for a failure caused by an event of force majeure within the meaning of article 1218 of the French Civil Code, or by the failure of a third party it is not answerable for: the game, Steam, Discord, Stripe, the network, the host.
Personal data
Billing data is processed as described in the privacy policy. The publisher and Stripe each act as controller for their own obligations.
Governing law and disputes
These terms are governed by French law. For a consumer, the mandatory protective rules of the country of residence still apply, and the court of their place of residence has jurisdiction.
Between businesses, failing an amicable agreement, the competent courts are those within the jurisdiction of the Paris Court of Appeal.
These terms are written in French. The English version is a faithful translation provided for information: if they differ, the French version prevails.
